Use
You can add the new Statutory Adoption Pay details for the selected employee on this screen.
Statutory Adoption Pay
This is a legal entitlement to a certain amount of pay to help an employee (male or female) adopting a child take time off work around the time the child is placed with them. It is available to:
- individuals adopting a child on their own, or
- one member of a couple adopting a child together. It lasts for up to 39 weeks
The adopter is allowed to take up to 26 weeks ordinary leave and 26 weeks additional leave but only the first 39 weeks are covered by SAP. The adopter is entitled to 52 weeks statutory adoption leave regardless of any entitlement to SAP. For further information relating to adoption leave go to Click here
SAP rates
If your employee is entitled to SAP, the amount you'll have to pay during the first 39 weeks of their adoption leave is the lower of:
- £172.48
- 90 per cent of their average weekly earnings
SAP Entitlement conditions
To qualify for SAP when adopting a child the employee must:
- be a person with whom a child is, or is expected to be, placed for adoption under UK law
- be employed by you continuously for at least 26 weeks continuing into the week they were told by the adoption agency that they had been matched with a child. Count part weeks of employment as full weeks.
- Have stopped working for, or taken leave, from the employer / contractor
- Have average weekly earnings at or above the LEL that applies at the end of the Matching Week
- Give the employer / contractor notice of when they expect the liability to pay SAP to begin at least 28 days beforehand. Where this is not reasonably practicable it must be given as soon as is practicable. [For adoption leave notice must be given within one week of issue of the certificate notifying the adopter that they have been matched with the child.]
Adoption Pay Period (APP)
Leave can start on the date the child is placed or up to two weeks in advance of the expected date of placement. Leave and APP can start on any day of the week. Leave can only be taken in whole weeks.
SAP cannot be paid by an employer / contractor to an employee for any week during which the employee does some work for that employer / contractor or is entitled to be paid SSP.
The maximum entitlement to SAP is for 39 weeks. There is a further entitlement to 39 weeks unpaid additional adoption leave.
SAP will end if the employee dies or is taken into legal custody (mirroring SMP). If the employee is released from legal custody before the end of the APP IR will take on the liability to pay the SAP.
Unlike SMP a week during the APP does not start on a Sunday and end on a Saturday but is a period of 7 days. For example if the employee starts their leave on a Tuesday, then the APP runs from Tuesday to Monday; if they start their leave on a Friday, then the APP runs from Friday to Thursday.
Recovery
Employers / Contractors can recover either 92% of the SAP they have paid, or 100% plus compensation if they qualify for Small Employers Relief (SER). The qualification for SER, and the amount of compensation are the same as for SMP.
Interaction with SSP
If the employee is sick before they have started their APP, the APP should be delayed until they are well.
If the employee notifies their employer / contractor that they are sick during the APP then there will be no entitlement to SAP during any week in the APP in which the employee is entitled to be paid SSP. An employee can get SAP while sick and serving their waiting days for SSP.
An employee who is, exceptionally entitled to SAP but not SSP can continue to get SAP while they are sick
Adopter
means the person (s) who are going to adopt a child. They may be going to adopt a child on their own, or with their partner.
Matched/Matching
means the adoption agency has decided that a person is suitable to adopt a particular child. The adoptive parent(s) may be given a matching certificate letter from the agency.
Matching date
means the date when the adoption agency told the employee that they had been matched with a child.
Matching week
means the week when the adoption agency told the employee that they had been matched with a child.
Placed
means the child starts living with the person permanently with a view to being formally adopted in the future. They may have stayed with them before this date.

Add SAP Details
- Select SAP Payment Type: Select the appropriate option to indicate the effect SAP will have on your employee's basic pay. This usually depends on your company's own policy.
- Reduce Full Basic by Statutory Pay Amount: Select this option if it is your policy to offset the employee's gross basic pay by the amount of SAP he or she is eligible to receive. i.e. the employee's gross basic pay will be reduced by the SAP amount. For example: the employee's normal gross basic wage is £500. This week she is eligible to receive £90 SAP so her gross basic wage will be reduced to £410. £410 basic + £90 SAP = £500.
- Add Statutory Pay Amount to Timed Basic Pay: Select this option if you want SAP to be paid in addition to gross Basic pay. For example: if gross Basic pay is £500 and SAP is £90, then the employee will receive £590 gross pay.
- Pay Statutory Pay Amount Only (either SSP / SMP / SAP/ SPP/ShPP): Select this option if it is your policy not to pay your employee their basic pay when she is receiving SAP. Only SAP will be paid for the weeks the employees eligible to receive it.
- Match Notified Date: Enter here the date on which the match was notified. Match means the adoption agency has decided that the person is suitable to adopt a particular child. You will find this date on the Matching Certificate. You can use the calendar button to enter the date the match was notified. Note: Your employee must produce evidence that they are adopting a child through an adoption agency to get SAP. This may be a letter confirming that the adopter/employee has been matched with a child.
- Child Expected Date: Enter here the date on which the child is expected to be placed for adoption. You can use the calendar button to enter the date
- Child Placed Date: Enter here the date on which the child is actually placed i.e., the date the child actually starts living with their new family. You can use the calendar button to enter the date
- Notified Leave Start Date: Enter here the date on which the employee told you they plan to start their adoption leave. You can use the calendar button to enter the date
- Return to Work Date: Enter here the date on which the employee is expected to return to work. You can use the calendar button to enter the date
- Disrupted Date: If the placement is terminated for any reason, enter the date, it terminated here. Entitlement to SAP will remain for 8 weeks if the placement is disrupted after it has started, or if the child dies after placement. You can use the calendar button to enter the date
- Enter Average Weekly Earnings manually: Select Yes from the drop down list if you wish to manually calculate and enter your employees average weekly earnings.
- Average Weekly Earnings: Enter here the average weekly earning of the employee.
- Manual Calculation: Select Yes from the drop down list if you wish to manually calculate and enter your employee's SAP amount.
- SAP Amount for Manual Calculation: If you have selected manual calculation, then enter the amount of SAP you wish to pay to the employee.
- Date of leaving: If the employee has left your employment enter here the leaving date.
Note: if the employee leaves after the adoption agency told the adopter that they had been matched with a child, it doesn't matter why they left of that they aren't coming back they are entitled to SAP as long as they don't start working for another employer / contractor.
This section is only applicable if you are migrating your data from your current payroll package
- Total number of weeks paid for SAP (Current plus Previous Tax Year Weeks): If you are migrating from another package, please enter the total number of weeks that have been paid for the SAP in previous & current tax year. If you are not migrating, please don't change the figure here, unless you specifically know what you are doing. This field cannot be edited after you update the YTD.
- Total amount of money paid for SAP (Current plus Previous Tax Year Amounts): If you are migrating from another package, please enter the total amount that has been paid for SAP in previous & current tax year. If you are not migrating, please don't change the figure here, unless you specifically know what you are doing. This field cannot be edited after you update the YTD.
- Total amount of money paid for SAP (Current Tax Year Amounts only): If you are migrating from another package, please enter the total amount that has been paid for SAP in this current tax year. If you are not migrating, please don't change the figure here, unless you specifically know what you are doing. This field cannot be edited after you update the YTD.
